Deadlines

## Some immigration deadlines *are very short.*

If something has gone wrong, the date you were told matters. Call us before you assume it's too late.

- 15

**days to go to the Federal Court after a refusal in Canada**
- 60

**days if you applied from outside Canada**
- 90

**days to apply to restore expired status, in most cases**

- **You've been refused**The Federal Court deadline runs from when you were told, and a reconsideration request doesn't pause it.
- **Your status has expired**You may be able to restore it, but you can't work or study while you wait.
- **You've been called to a hearing**Admissibility hearings and misrepresentation findings can lead to removal and a ban on returning.
- **Your file is stuck**A long, unexplained delay can sometimes be challenged at the Federal Court.

How it works

## From first call *to a decision.*

Your lawyer handles your file personally, so you always know who's working on it and where it stands.

 [Ask about your file](#review)

1. **First meeting**Tell us what's happening, by video (free) or in person ($100). Bring any letters you've received.
2. **Read the file**Your lawyer reviews the application, the decision and, where useful, the officer's notes, so the plan fits what actually happened.
3. **A clear plan**You'll hear which options fit, what each involves and any deadline you're working to.
4. **We handle it**We prepare the application or challenge and deal with IRCC, the Immigration and Refugee Board or the Federal Court.

Questions

## Immigration *questions*

Don't see yours? Call [(289) 309-3069](tel:+12893093069).

My application was refused. How long do I have to challenge it?

To go to the Federal Court, 15 days from when you were told of the decision if you applied from inside Canada, or 60 days if you applied from outside Canada. Asking the officer to reconsider doesn't pause that deadline.

My application is taking far too long. What can I do?

First, we check where the file stands and whether anything is missing. If the delay is unreasonable, we can ask the Federal Court for an order called mandamus, which directs the government to make a decision.

My status in Canada has expired. Is it too late?

Not always. In most cases you can apply to restore your status within 90 days of losing it, if you met the conditions of your stay. You can't work or study while you wait. Speak to us quickly.

Do I need a lawyer, or can I apply on my own?

Many people apply on their own. A lawyer helps most when something has gone wrong: a refusal, a long delay, an inadmissibility finding or a removal order. Only a lawyer can represent you at the Federal Court, though you can also represent yourself there.

Can you help if I live outside Canada?

Yes. We act for immigration clients anywhere in the world who have a Canadian immigration matter. Meetings can be by video, and many visa refusals and sponsorship files involve people abroad.

 Is the first meeting free?

Video meetings are free. In-person meetings at First Canadian Place are $100.
