Fees

## Little or nothing upfront. *The rest only if you're compensated.*[*](#fee-note)

For injury and contract claims, you don't pay by the hour. You'll know how the fee works before you sign.

- **Free video meeting**Talk through what happened before you decide anything.
- **Paid from a settlement or award**Either a small amount upfront and the rest from your compensation, or the whole fee from it.
- **Everything in writing**A written contingency fee agreement sets out the percentage, HST and disbursements.
- **Contract claims too**Breach of contract claims are charged the same way.

Deadlines

## Some notices are due *within days.*

Most claims must be started within two years. A few need written notice much sooner, and missing it can put the claim at risk.

- 10

**days to notify the city after a sidewalk or road fall**
- 60

**days to give notice after a fall on snow or ice**
- 2

**years to start a lawsuit, in most cases**

- **City sidewalk or road**Written notice to the city within 10 days if a poorly kept road or sidewalk caused the fall.
- **Snow or ice on private property**Written notice to the owner, occupier or snow contractor within 60 days.
- **Dog bite**In Ontario, the dog's owner is liable for a bite or attack. The usual two-year limit applies.
- **Disability benefits denied**Many policies set their own appeal deadlines, so check the denial letter and policy right away.

How a claim works

## Five steps, *one lawyer throughout.*

Every claim is different, but most follow this path. We tell you at each step what's happening and what comes next.

 [Ask about your claim](#review)

1. **Free video meeting**Tell us what happened. We explain whether you have a claim, your deadlines and how fees work.
2. **Notices go out**We send any notice that's due, sometimes within *10 or 60 days*, so the claim stays open.
3. **Build the evidence**Medical records, photos, witness details, policy documents and proof of lost income are gathered.
4. **Negotiate or sue**We present the claim to the insurer or the other side, and start a lawsuit within the *two years* where needed.
5. **Settlement or trial**Many claims settle. If yours doesn't, we take it to court.

- **In person or by video**Meet at First Canadian Place, or by video if travel is hard after an injury.

Questions

## Injury and contract *questions*

Don't see yours? Call [(289) 309-3069](tel:+12893093069).

How do fees work for an injury claim?

Either a small amount upfront and the rest only if you're compensated, or no legal fees at all unless you're compensated.[*](#fee-note) The fee is a percentage set out in a written contingency fee agreement, plus HST, and we explain it before you sign anything. Disbursements are handled as that agreement sets out.

How long do I have to make a claim?

In most cases, two years to start a lawsuit. Some notices are due much sooner: 10 days to give written notice to the city after a fall caused by a poorly kept road or sidewalk, and 60 days after a fall on snow or ice on private property. Long-term disability policies often set their own appeal deadlines.

Do fees for contract disputes work the same way?

Yes. A breach of contract claim is also on a contingency fee: either a small amount upfront and the rest only if you're compensated, or no legal fees at all unless you're compensated, under a written contingency fee agreement.

Will I deal with a lawyer or with a case manager?

With your lawyer. Cohen Murison Law is a one-lawyer firm, so the person you meet at the first meeting is the person who handles your file and returns your calls.

I'm in Canada on a permit and was injured. Can I still claim?

Being on a temporary permit doesn't by itself stop you from making a claim. We also practise immigration law, so we can explain how a claim and your status affect each other.

 Is the first meeting free?

Video meetings are free. In-person meetings at First Canadian Place are $100.
